Criminal Dallas Lawyer
Along with almost every other attorney in the State of Texas, I've been following James Vasilas' case as its traveled the appellate highways (e.g., my May 1, 2006 post). Now, Judge Charles Sandoval has issued a memorandum opinion from his bench on the 380th Judicial District Court of Collin County that should be a welcomed relief not only to Brother Vasilas, but to some degree to lawyers everywhere.
He hears non-criminal matters that can be complex and involve a lot of money. For example, this past June the Dallas company ICC Energy Corporation filed a big lawsuit in his court against Oklahoma City's Chesapeake Energy Corp (NYSE: CHK) claiming that Chesapeake breached a deal with ICC to market gas from the Barnett Shale at the Dallas-Fort Worth International Airport. Millions are at stake.
also has the distinction of being the first sitting judge in the history of the State of Texas to be sued -- yep, sued -- by the Texas Attorney General. The Attorney General sued Judge Priddy and got judgments against the Judge for failing to file campaign finance reports with the state Ethics Commission. Judge Priddy got $39,000 in fines and after paying $31,500 to the Ethics Commission, the remaining $7,900 was recovered by garnisheeing his bank account. He still owes the State thousands in attorneys' fees, accrued interest, and a $500 late filing penalty.
This past Thursday, Baez filed a motion seeking a court order to stop the prosecution's testing and handling of forensic evidence until the Judge can set rules on how this testing should occur. Baez is arguing that forensic testing can destroy the forensic samples, and he wants the Judge to oversee how this key evidence is tested, as well as what methods are used. Baez also wants a member of his defense team to observe the testing.Why is Baez requesting all this -- even before his client is charged with anything BASED upon this evidence He's urging that this court oversight is needed to protect Anthony's right to a fair trial.
Baez filed a Motion to Decrease the Half-Million Dollar Bail earlier, and not only was that denied by the trial court but the appellate courts upheld the bond amount. Remember, excessive bail is prohibited by the U.S. Constitution and Casey Anthony is only charged with two things in connection with this bond amount: child neglect and giving false information to the police. This is an extremely high bond for these charges.
Well, those in the know have long recognized that this isn't reality -- but never more so than this past month, when the Texas Department of Public Safety publicly admitted that its criminal history records database is far from complete. According to Angie Klein, who manages this database, it's only got 69% of the state's actual criminal records.
As far as the Court of Criminal Appeals is concerned, a lawyer that makes a mistake in a civil Petition he filed can be charged with Felony Tampering With a Governmental Record. After both a Collin County District Judge and the Dallas Court of Appeals logically reasoned that a Petition generated by and filed by a lawyer could not be a "governmental record", the high court somehow found that it could be part of the definition set by the legislature. Unless the Dallas Court of Appeals rules that the Rule 11 provisions of the Texas Rules of Civil Procedure is in pari materia to this type of obtuse allegation, the Court of Crimial Appeals cleared the way to prosecuting all civil and criminal lawyers for making mistakes in their Petitions or other records typically filed by lawyers in Texas.

Cancer Mesothelioma
Mesothelioma is a rare form of cancer in which malignant (cancerous) cells are found in the mesothelium, a protective sac that covers most of the body's internal organs. With rare exceptions, most mesothelioma cancers are considered malignant mesothelioma. The two major types of malignant mesothelioma are pleural mesothelioma, which concerns the mesothelium membrane that surrounds the lungs, and peritoneal mesothelioma which concerns the mesothelium layer that covers the organs in the abdominal cavity. The prognosis, therapy (including types of chemotherapy) and treatment choices are similar whether the cancer is pleural mesothelioma or peritoneal mesothelioma.
Standard treatment for all but localized mesothelioma is generally not curative. Surgery and radiotherapy have a limited role in highly selected mesothelioma patients and chemotherapy is the only potential treatment option for the majority of people diagnosed with mesothelioma. Sometimes, these mesothelioma therapies are combined. Despite activity of some chemotherapy, the results are still modest, with a median survival of approximately one year. For individual patients, treatment for mesothelioma depends on the location of the cancer, the stage of the disease, and the patient's age and general health. The only FDA approved chemotherapy for malignant pleural mesothelioma (in combination with cisplatin) is pemetrexed (Alimta). In the key clinical trial that led to its approval for mesothelioma, Alimta was combined with another chemotherapy drug (cisplatin) and compared with cisplatin alone. The median survival for the patients who received both chemotherapy drugs was 12.1 months versus 9.3 months for mesothelioma patients who only received cisplatin.
In general the prognosis of mesothelioma is poor and most studies report median survival of less than a year. However, there are long term mesothelioma survivors (both pleural and peritoneal survivors) who have survived more than 10 years. In fact, in one mesothelioma study, doctors writing about the prognosis of mesothelioma explained that long-term mesothelioma survivors do exist and their prognosis may be independent of the treatment or therapies pursued. If this is true, it would suggest that mesothelioma prognosis and survival may be more dependent on individual differences among patients (and perhaps the non-conventional therapies they use) and less dependent upon conventional mesothelioma treatments.
Shortness of breath and pain in the chest due to an accumulation of fluid in the pleura are often symptoms of pleural mesothelioma. Symptoms of peritoneal mesothelioma include weight loss and abdominal pain and swelling due to a buildup of fluid in the abdomen. Other symptoms of peritoneal mesothelioma may include bowel obstruction, blood clotting abnormalities, anemia, and fever. If the cancer has spread beyond the mesothelium to other parts of the body, symptoms of mesothelioma may include pain, trouble swallowing, or swelling of the neck or face.
Diagnosing mesothelioma is often difficult, because the symptoms are similar to those of a number of other conditions. Diagnosis begins with a review of the patient's medical history and a complete physical examination may be performed, including x-rays of the chest or abdomen and lung function tests. A CT (or CAT) scan or an MRI may also be useful. A biopsy is often used to confirm a diagnosis of mesothelioma. Mesothelioma is described as localized if the cancer is found only on the membrane surface where it originated. It is classified as advanced if the mesothelioma has spread beyond the original membrane surface to other parts of the body, such as the lymph nodes, lungs, chest wall, or abdominal organs.
Over 2,000 new cases of mesothelioma are diagnosed in the United States each year. Mesothelioma occurs more often in men than in women and risk increases with age, but this disease can appear in either men or women at any age. Working with asbestos is the major risk factor for mesothelioma. A history of asbestos exposure at work is reported in the majority of cases. However, mesothelioma has been reported in some individuals without any known exposure to asbestos.
Asbestos is the name of a group of minerals that occur naturally as masses of strong, flexible fibers that can be separated into thin threads and woven. Asbestos has been widely used in many industrial products, including cement, brake linings, roof shingles, flooring products, textiles, and insulation. If tiny asbestos particles float in the air, especially during the manufacturing process, they may be inhaled or swallowed, and can cause serious health problems. In addition to mesothelioma, exposure to asbestos increases the risk of lung cancer, asbestosis (a noncancerous, chronic lung ailment), and other cancers, such as those of the larynx and kidney. There is evidence that family members and others living with people exposed to asbestos have an increased risk of developing mesothelioma, and possibly other asbestos-related diseases. This risk may be the result of exposure to asbestos dust brought home on the clothing and hair of asbestos workers.

I like to focus part of my trading day on scalp plays, where I'm jumping in and out of the market with a little piece here, and a little piece there. However, I also like to focus a part of my time on catching potentially bigger intraday moves, as well as multi-day and multi-week moves. What I'll do is focus on scalp plays in one account, and use a second account for swing plays. The Box Play and Squeeze Play are diverse setups that can be used for both scalp plays and swing trades. For intraday trades, I use 5 and 15 minute charts. For swing trades, I use 60 minute and daily charts.
The one thing a trader soon learns about the markets is that they will never move straight up or straight down forever. A market can definitely rip higher for long time, but at some point it will have to rest and consolidate, and sometimes it will even come back down to earth and reverse all of those spectacular gains. Just as a runner can only sprint for a limited amount of time before their body gives out, a market can only move so far before it needs to pause, take a rest, and build up its energy reserves for the next major move.
For Box Plays, what I'm looking for is a market that is taking a rest before its next spurt higher or lower. I want to see a period of horizontal consolidation with at least two tests of the highs and two tests of the lows. Once I get these two tests, then I'm looking to buy a breakout of the box, or sell a breakdown of the box. My target on these trades is the width of the box. These plays can be done on all time frames, though my preference for day trading is 5 and 15 minute time frames. For swing trades, a trader can look to the 60 minute and daily charts. I trade these as both swing and intraday plays, with each time frame independent of itself (meaning I could have a 60 minute box play going and a 5 minute box play going at the same time, with different parameters and in different directions). Also, since the Euro actively trades around the clock, these box plays can be setup at anytime. I like to try to get some sleep each night, but on those nights when I get shafted by the wait staff (i.e., I order decaf coffee after dinner but they give me caffeinated, so I end up lying in bed staring at the ceiling), I can at least get up and check if a box play is forming overnight.

If it is above zero when this happens, I go long, if it is below zero, I go short. These are all canned studies that come with most charting packages. For the parameters, I just use the default settings on TradeStation. I also took an extra step and turned all of these into an indicator which makes it easier to read on the chart.

But it is online that this game comes into its own. From Deathmatch to the more tactical Search and Destroy, the action is exciting and addictive.
